Yes, subject to the condominium and payment conditions

Foreign nationals can buy qualifying condominium parcels in Sri Lanka. Section 3(1)(b) of the Land (Restrictions on Alienation) Act, as replaced by Act No. 21 of 2018, provides a condominium exception subject to the full value being paid upfront through an inward foreign remittance before the transfer deed is executed.

An advertisement calling a property an apartment does not establish that it qualifies. Have an independent Sri Lankan lawyer/notary confirm the property's legal status and the route available to you before signing a reservation agreement or paying a deposit.

Editorial review: 28 September 2026. This guide explains the published framework and questions to resolve; it is not a legal opinion on your transaction. Ask your lawyer and bank to confirm the rules, documentation and payment arrangements applicable at the time of purchase.

Check what you are actually buying

Ask the lawyer to identify the exact condominium parcel, registered plan, title documents and seller's authority. Check how parking, storage and rights in common areas are recorded. A marketing floor plan and a promised unit number are not substitutes for the documents needed to transfer ownership.

For a completed unit, request the relevant building approvals, completion documentation, management information and details of outstanding charges. For an apartment under construction, establish what exists now, what must be completed or registered later, and what protects your payments if handover or title transfer does not happen as agreed.

Do not apply the condominium exception automatically to a detached house, bare land or a share in a company. Each proposed ownership arrangement needs its own legal assessment. Dual citizenship, joint ownership and corporate purchases also require the adviser to identify the correct rules rather than relying on a general foreign-buyer label.

Agree the banking route before sending money

Coordinate the payment plan with both your lawyer and a bank authorised to handle the transaction. The Department of Foreign Exchange describes the Inward Investment Account (IIA) as a route for eligible investors to fund permitted investments. Its Directions No. 15 of 2021 set out eligibility and permitted account transactions, including provisions relevant to condominium purchases.

Ask the bank which account and transfer route apply to your circumstances, what evidence it requires and how the remittance will be linked to the purchase. Do not assume that using any foreign-currency account, paying an agent overseas or obtaining local finance meets the requirements.

For instalment or off-plan arrangements, have the bank and lawyer reconcile each payment with the agreement and the statutory payment condition before you commit. Confirm the recipient independently and retain bank confirmations, receipts and the signed payment schedule.

  • Confirm the account holder, beneficiary, currency and purpose recorded for each transfer.
  • Ask what identity, residency and source-of-funds documents the bank needs.
  • Allow for conversion charges, bank fees and exchange-rate changes between instalments.
  • Agree how a refund would be documented and returned if the purchase does not complete.

Budget beyond the advertised price

Request a written, itemised estimate for your transaction. A permitted purchase is not automatically tax-free, and a seller's headline price may not include every charge. Have the lawyer/notary and a tax adviser identify the applicable treatment rather than applying a single percentage from an online guide.

Property ownership and permission to reside are separate

Do not treat an apartment purchase as a visa approval or permission to work. The Department of Immigration and Emigration publishes residence-visa categories with their own eligibility, application and documentary requirements.

If you plan to live in Sri Lanka, confirm the appropriate visa route, permitted activities, duration and renewal conditions directly with Immigration before making the purchase depend on that plan. If a seller promotes a property-linked residence programme, verify its current conditions independently rather than relying on the sales brochure.

Plan for renting out or selling the apartment

Before relying on rental income, check the building's rules, applicable rental or tourism requirements, tax obligations and arrangements for managing the unit while you are abroad. Budget for vacancy, repairs and management expenses; an advertised yield is not guaranteed income.

Ask your bank at the outset what records it will require for future remittance of income or sale proceeds. Keep the purchase agreement, deed, inward-remittance records, account statements and tax documents together. The applicable foreign-exchange rules and bank checks at the time of a later transfer will matter; do not assume an immediate, unrestricted transfer abroad.

Your checklist before paying a deposit

  • Independent lawyer/notary appointed and buyer eligibility assessed.
  • Exact parcel, seller's authority, title and relevant approvals checked.
  • Outstanding mortgages, building charges and transfer conditions identified.
  • Banking route and evidence of qualifying payment agreed with the bank and lawyer.
  • Reservation, refund, delay, completion and handover terms reviewed in writing.
  • Full purchase and ongoing ownership costs budgeted.
  • Any intended residence, rental use or financing assessed separately.
  • Completion records and future remittance documentation planned.

Frequently asked questions

Must a foreign buyer choose an apartment above the fourth floor?

The replacement condominium provision in the 2018 amendment contains no floor-level threshold. The property's qualifying legal status and payment conditions still matter. Have your lawyer assess the exact unit rather than relying on older summaries.

Does a tourist visa establish purchase eligibility?

A visa and the legal ability to acquire the property are separate matters. Your lawyer must assess the purchase, while Immigration determines permission to enter, remain and undertake activities in Sri Lanka.

Can I pay a deposit before opening the required account?

Agree the complete payment route with your bank and lawyer first. Ask how any reservation payment will be documented and treated; do not assume it can be corrected later.

Can I use a local mortgage?

Do not assume financing availability or compliance. Ask a lender and your lawyer to assess your status, the proposed loan and how the payment condition will be satisfied before signing a purchase agreement.

Does buying through a local company remove the checks?

No. Corporate ownership and foreign shareholding require a separate legal assessment. A company or nominee arrangement is not a substitute for establishing a lawful acquisition route.

Is an off-plan reservation the same as owning the apartment?

No. A reservation or sale agreement sets contractual rights and obligations. Ask your lawyer when the parcel can be transferred and registered, what approvals are outstanding and how payments are protected.
